Warranty
MagnaGrafik expressly warrants every MagnaGrafik product to be free of
defects in materials and workmanship as of the date of purchase, and makes
no other express warranties whatsoever. MagnaGrafik's™ liability for any
claim for breach of this express warranty or of any implied warranties,
including the warranties of merchantability, shall at MagnaGrafik’s election,
be solely to (1) the replacement of the entire product or part of the product,
or (2) the refund of the purchase price less the cost of freight.
Except as otherwise provided herein, under no circumstances shall MagnaGrafik be
liable for any direct, incidental, consequential or exemplary damages.
MagnaGrafik expressly disclaims any claims for breach of any implied warranties
of merchantability, fitness for a particular use, or otherwise, and shall not under
any circumstances, be liable for damages caused by or arising out of (1) the improper
use of a Magna-Grafik product, (2) improper installation of a MagnaGrafik product,
and/or (3) modification of a MagnaGrafik product.
